No, it makes perfect sense. No double jeopardy is a very important part of the law. Otherwise you could be retried by the government over and over until they finally find you guilty of whatever crime they want. Even if they never got a conviction they could ruin you in legal fees.

Illegally obtained evidence being inadmissible is also important if you want your constitutional protections to have any meaning whatsoever.

Regardless, they DID search his property and found child porn. And simply because of a small technicality not only does he get off, but the evidence obtained can never be used against him?

They'll most likely watch him for CP now that they know it's there. He needs to do something to justify a warrant though in order for what he currently has to be searched. You may not like that it's protecting someone into CP here but I guarantee you would like it even less if a cop searched through your home because everyone is doing something wrong and they want to find a law you're breaking.

By throwing out this trial, the evidence has never been used against him so unless he destroys it, it can be collected and used in the future if/when he screws up.

This story is all about using an emotional appeal to change laws. Please think about this rationally, or better yet take a couple of intro classes on law and trials.

Wrong. That is precisely how the law works. Probable cause is a requirement for a warrant, and a warrant allows a search and seizure of only precisely what the warrant specifies. If they find something unrelated to the warrant they cannot use it at that point in time.

Yes, thats what I thought.
And did say as much.

I dont think this is so much about the law, but more about the use of propaganda to change it.

A captive prisoner is allowed to escape, even if aided by the police so it's not really the same thing. The prisoner being alive would be able to press charges as well, which would then give cause to search the premises and find evidence.

The bomb and terrorist plans should be protected but thanks to the Patriot Act and NDAA there is an exception that says anything terrorism related isn't protected. The police would wrongfully be allowed to arrest and prosecute in that case.
