I don't know if I can say it any more simple. The law applies to the Sec Def, Obama is not the Sec Def, thus Obama can't break that law.

Always wondered why 0bama picked that dullard for SecDef. Cheap and easy patsy, huh?

That will teach Obama not to hire incompetent Republicans to do jobs that require competence lol.

The Unified Chain of Command which Obama is not just a part of, but Chief of as it's leader...doesn't give him a free pass like that. Not even close and especially on military matters of direct and critical national security.

However, lets say for a moment Obama can be held blameless through ignorance as is usually the claim.

Fine..then I'd like to see two things and we don't need to know more for them to happen if THAT is how we claim it went down.

#1. Hagel should be asked for his resignation by the end of business today.

#2. Obama should be defending himself and his future to keep his office for why it wasn't done MUCH SOONER to deal with a rogue civilian Sec-Def.

I'm not saying we cant do anything about it.
that's when the whole impeachment process is all about.

This whole, a Sitting President 'Not' being Subject to Compulsory Criminal Process was put in place so as not to distract him from his duties.

without that ruling any number of suits or criminal complaints could be made, valid or not...thus disrupting the office President.

Once he stops being President you can sue him all you want. But while he's in office his pretty much untouchable

His claim is that Obama can not break that law regardless of whether he told Hagel what to do or not. He is claiming that the blame is entirely on Hagel to notify congress and he holds all the blame. The buck doesn't stop at President Obama, it stops at the secretary of Defense, at least in this case.

I'm not saying I agree, just trying to help you understand his position, you two keep repeating the same thing.

I understand what you are saying, and why the process is set up the way it is.

But, Obama on his own, for personal reasons, I don't understand. Made the choice to exclude other branches of government in the release of very powerful and influential TERRORISTS back into the position of being able to put all American citizens at high risk of harm. That doesn't even include the peoples those TERRORISTS were attempting genocide on...on their own turf.

To me, this is much more dangerous, than Clinton leaving stains on Monica's dress in the oval office, and what the definition of is, is. That didn't kill anyone.

Bottom line, Obama can't break THAT law...only Hagel can.

Nothing will happen because Republicans would have to charge a Republican to even get the ball rolling and they aren't going to do that.

You should change your title to "The Law That Hagel Broke".
