No, they don't own that part of the sea, but all naval ships are surrounded by a no fly zone. You DO NOT fly anywhere near them, it's damn near an act of war.

I kind of see this as Putin, yet again, pushing to see just how far he can push. He has enough military might that if the US destroyer had reacted he could handle a war, but must just want to see how far he can push until he actually DOES start a war. Will be interesting to see how this plays out. I would love to know where the order came from to do this on the Russian side.

Could Putin be testing President Obama? It wouldn't be the first time a U.S. President was tested by a foreign power.

In the first public account of the incident, the officials said the Russian Fencer made 12 passes, and flew within 1,000 yards of the USS Donald Cook, a Navy destroyer, at about 500 feet above sea level.
Two Russian aircraft were present, but only one took part in the provocative actions, Warren said. The aircraft flew from near sea level to a couple of thousand feet, he added, but never overflew the U.S. Arleigh Burke-class destroyer.
“The Russian plane made a total of 12 passes,” he said.
The wingman stayed at a considerably higher altitude, Warren said.
Officials later said the aircraft approached within about 1,000 yards of the ship. The USS Cook was never in danger, Warren said.
“The Donald Cook is more than capable of defending itself against two Su-24s,” the colonel said.
Warren said he does not think this is an example of a young pilot joyriding. “I would have difficulty believing that two Russian pilots, on their own, would chose to take such an action,” he said. “We’ve seen the Russians conduct themselves unprofessionally and in violation of international norms in Ukraine for several months, and these continued acts of provocation and unprofessionalism do nothing to de-escalate the situation in Ukraine, which we called on the Russians to do.”

That being a bit of a maverick could cause a global crisis.
That is something you just do not do. Approaching another naval force with a jet fighter who does not respond to your calls to it to back off is nothing short of aggressive behavior.
If he was being a maverick, then Putin better reel him and anyone else like that in quick because we wouldn't allow something like that more than once to our ships.

If that jet was armed and still ignored the warnings you can bet it would have been shot down. Quit trying to split hairs when the point is that it WAS aggressive, WAS provocative, and nearly could have resulted in live fire. No one is trying to argue it WAS an act of war kiddo.
