The bar would be legally culpable if the patron drank too much left the bar and got a DUI/Accident/etc... Drinking too much and losing money at a casino is not a crime, so I don't feel this is an apples to apples comparison.

The bar would be legally culpable if the patron drank too much left the bar and got a DUI/Accident/etc... Drinking too much and losing money at a casino is not a crime, so I don't feel this is an apples to apples comparison.


If that drunk person stumbled upstairs in a hotel after leaving the hotel bar, and died from asphyxiation after over consuming and vomiting, the hotel would be liable for a wrongful death suit.

I run bars, among other things.

Agreed, but that's not the scenario here. The scenario is that a man got drunk and gambled away a small fortune, which is not a crime (Gambling drunk)...

The culpability is on the organization that chooses to cash in on your desire for alcohol, with disregard for your health.

I am not saying the guy is right or wrong. Only saying that if a bar cannot allow a guest to overconsume, neither should a casino. In a casino you are actually preying on 2 psychological problems: alcohol and gambling addiction. Feeding those addictions to exploit for a profit.

Casino's are not a business that is going to get a lot of sympathy from me. They are a predatory industry that pumps their target consumers full of booze to decrease their ability to make decisions. They should be able to conduct business, for sure. but as a guy who runs a bar, and must hold back on aggressive sales strategies because, legally, i am responsible for my customers, it pisses me off that a casino will get a free pass.

This is a problem with the modern world, everyone has someone to blame vs taking accountability for their actions.

This guy is a drunk with a gambling problem and it sucks that he lost a lot of money but no one made him drink or gamble.

But who says he was over served? We are going off his word that he "blacked out" which led to him gambling recklessly... Maybe he's just some degenerate gambler who had a few drinks (no disputing that) and hit a bad streak and couldn't stop himself. The issue here is that there is no way to prove he was over served or if he did in fact blackout. I feel this is a major excuse on the gamblers part to try to cover his own ass for losing a small fortune. He is attempting to push the blame onto someone else and not take responsibility for his own actions as an adult.

BFFT...you and I usually see eye to eye on most subjects. I understand your frustration. But, this is different than a nice bar, where the ratio of customers to employees is much smaller than a huge casino floor with multiple bars where the customer can freely roam from one to another.

I'm sure you train your bar help to spot those who imbibe too much, and know to cut them off. It's not that easy for casino employees to gauge how much a customer has had to drink. I've been in a casino in Tahoe and have seen people cut off by a bartender, and had the floor boss come to escort them out. They can't be baby sitters for all the drunks who arrive at casinos to party down like the world is ending.

When do individuals cross the line to the point of not being responsible for their own actions. We are seeing all too much in our society, people saying NOT MT FAULT, and finger pointing at others to place the blame on.

There has to come a time, when people must look in the mirror, and say...yep...I did that. It was stupid, but, I'm an adult and knew that getting crapfaced drunk and gambling sometimes will get me in hot water.

I think it is asinine that I am responsible for some redneck who can't hold his liquor. I also think this guy (the casino guy) is 100% responsible.

I took the position of the devils advocate to highlight the hypocrisy between the casino and the bar. Because bottom line, regardless of how many patrons you have (and we have quite a few), you are still held responsible for what and how much you serve them.

Nope...we agree that this guy screwed up and should own it. I just wish the same sentiment was carried over into the bar.

I will agree with you there. I do believe a bar manager/servers/bartenders have to be concerned about their job, but I never understood why they had to play babysitter to the amount of drinks a patron was consuming. How are they supposed to know each random persons tolerance. I've seen some guys who can put down a case of beer no problem and I've seen others who get a little loopy off just one. It's hard to gauge where all your customers are at, while attempting to handle the other aspects of your job.

The law here in Canada ie BC....is the same Tex....
Bars and bartenders can get hefty fines etc for overserving booze to oblivious patrons.....
Also the responsibility for further damages upon letting the customer leave are up for grabs....Private party hosts are also on the hook.....
The laws are all slanted towards this kind of social engineering...............they are not for freemen and women....

LOL, I'm sure many will do the same exact thing... It would essentially be a free roll on your wealth to double/triple/etc...

Plan

Step 1- Get hammered

Step 2- Find Casino

Step 3- Gamble like a mad man, either winning or losing

Step 4 (If you win)- Enjoy the rest of your vacation

Step 4 (If you lose)- Blame being over served and sue the casino

And repeat..... haha

What if he had won $500,000 being drunk, then woke up the next day and didn't remember it? Would he have given it all back? No! and HELL no! So, my suggestion to him is give up drinking while gambling or give up gambling while drinking or give up drinking and gambling! I do not condone the actions of the casino, however. Should they be sued? That is questionable. There is obviously video documentation involved and whether this man can prove his allegations does not allow for him to be forgiven of his debt. He gambled. He lost. He should be glad the "old school" boys haven't showed up with a pair of pliers and a chainsaw and got "pulp fiction medieval" on his buttocks! The casino should be reprimanded and fined either way by the Gaming Commission. Maybe, some of the debt can be forgiven, but I guess this has to be determined by a jury and a judge to see how much and where it should have stopped.

I don't like gambling.
Not one bit. I don't know what it is, but it's just not for me. I don't feel any rush, just disappointment after wasting money.


The following is my opinion as a member participating in this discussion.

If I lose, that sucks. If I win, I'm angry I didn't bet more. Pretty much a no-win. Definitely not my idea of a good time. Although I can wander around a casino for prolonged periods and be amused just by observing.

As for this guy, I don't have enough verified info. If he was sloppy drunk and they were letting him bet, I have a problem with that. At this point, I don't know if he's just sorry he lost, or really was taken advantage of. Either way, there's no way a legit casino will knowingly let him play after this even if he's sober as Carrie Nation.

He might get some play in some underground back-room game, but asking for a refund after losing in one of those might get you killed.

I'm an avid casino goer, Atlantic City. As a matter of fact, I co own a business that arranges trips to an Atlantic City casino.
I can sit at a machine or on a table 3-4 hours, one drink after another (Long Island Iced Teas) and not get the slightest buzz. The drinks in the casino are WATERED DOWN BIGTIME. This guy want bat crap crazy, took out iou after iou in hopes of hitting it big.
Here's a hint for you: The House ALWAYS WINS. BOTTOM LINE.
ANYONE going to a casino in hopes of hitting that jackpot is gonna be disappointed. Myself, when I go, I gamble to get the cops for food, free rooms, etc.

As fa as this putz goes, he gambled, HE LOST. Oh well, tough luck. Too bad there wont be a next time. ALL the casinos, even the ones in other states communicate, and he will be pretty much blacklisted in ANY casino he goes to.
Sad thing, the casino will probably settle with him to brush it under the table.

I know what you are saying, you want to hold violators of common sense freedoms to the absurd standards which they have advocated.

The problem with this response to ridiculous laws is that it at best produces even more ridiculous laws. Nanny statists don't get the irony and sarcasm and if things go really badly, they might very well agree with you.

We shouldn't use the law as a weapon against our fellow citizens at any time for any reason. We do not need to adopt the tactics of those who oppose freedom.

No one made this person go to the Casino.
no one made this person drink while he was there.
no one made this person gamble away that much money.


Personal accountability comes to mind. We need to stop blaming the state when individuals act stupid.
